DIGITAL OPERA RESEARCH AND INTELLIGENCE STUDY PRIVACY POLICY
This privacy policy (this “Policy”) describes the practices of Against The Grain Theatre and its partners, Ottawa Chamberfest, Canadian Opera Company, The Banff Centre for Arts and Creativity, Canadian Music Centre, Vancouver Opera, Edmonton Opera, Cowtown Opera, Pacific Opera, Lyric Opera of Chicago (hereinafter referred to as “we”, “us”, “our”) with respect to our collection, use, storage and disclosure of personal information you provide to us if you choose to complete our audience survey (the “Survey”). It also describes the choices available to you regarding our use of your personal information and how you can access and update this information.
By participating in the Survey, you acknowledge that you have read and understand the practices contained in this Policy.
1. Updates to this Privacy Statement
We reserve the right, at any time, to modify, alter, or update this Policy, and any such modifications, alterations, or updates will be effective upon our posting of the revised Policy. Your participation in the Survey following our posting of any revised Policy will constitute your acknowledgement of the amended Policy.
2. Applicability of this Privacy Statement
This Policy does not apply to information about you collected by any third party services, applications, websites, or advertisements associated with, linked to, or otherwise accessible from, the Survey, such as SurveyMonkey. The information collected or received by such third parties is subject to their own privacy policies, statements, and practices and under no circumstances are we responsible or liable for any third party’s compliance therewith.
3. What Information Do We Collect?
We collect a variety of personal information from and about you when you answer questions on the Survey.
You have choices about the information we collect. When you are asked to provide information, you may decline.
We may also collect data in connection with the Survey that is not considered “personal information.” To the extent such data is stored or associated with personal information, it will be treated as personal information; otherwise, such data may be used or distributed at our discretion.
4. How Do We Use and Disclose Information?
We use and disclose personal information for, or based on, one or more of the following: (i) your consent; (ii) as required or permitted by law; (iii) for our legitimate business purposes; (iv) as necessary to complete any transaction or provide you with information or services you have requested or authorized; (v) to provide services to our partners; and/or (vi) to fulfill our legal responsibilities, in each case as provided in this Policy. Operational Uses. We use your personal information as part of our operations, which include:
- Operating, maintaining, and improving the quality of performances;
- Communicating with you by e-mail if you have authorized us to do so;
- Compliance with applicable laws, regulations, rules and requests of relevant law enforcement and/or other governmental agencies;
- For other purposes, as permitted or required by law.
Marketing Uses. We may use your personal information to send messages to you about us, our partners, and the content, products and services offered by us and our partners. These communications may be tailored based on the communications preferences you select when providing us with your information; for example, we will not send you an e-mail unless you both consent to receive such communications and provide us with your e-mail address.

Sharing of Information. Some of the above uses involve sharing collected personal information with third parties, including service providers, affiliates, and partners.
In addition, we may disclose information we maintain, including personal information: when permitted or required to do so by law, or in response to a request from a law enforcement agency or authority or any regulatory authority; and/or to protect the interests, rights, property, or safety of Against The Grain Theatre, our partners, our patrons, and others.

Personal information is protected using various physical, administrative and/or technical safeguards. However, no method of safeguarding information is completely secure. While we use measures designed to ensure the protection of your personal information, we cannot guarantee that our safeguards will be effective or sufficient. In addition, you should be aware that Internet data transmission is not always secure, and we cannot warrant that information you provide via the Survey is secure.
6. Modifications and Corrections to Collected Personal Information
We strive to maintain the accuracy of any personal information that may be collected from you, and will use commercially reasonable efforts to respond promptly to update our database when you tell us the information in our database is not accurate. It is your responsibility to ensure that such information is accurate, complete and up-to-date when you answer questions on the Survey.
You may obtain from us the personal information in our records, although we may request certain reasonable additional information to help us authenticate such requests. If you wish to access, review, or make any changes to personal information you have provided to us through the Survey, you may do so at any time by contacting us as provided below.
7. Communications Opt-Out
By providing your e-mail address, you consent to receive marketing communications from Against The Grain Theatre and our partners based on the information provided and your communications preferences. You may opt out of receiving marketing or other communications from us via e-mail by following the opt-out link or other unsubscribe instructions provided in any email message received or by contacting us as provided at the end of this Policy.
8. Use By Minors
We do not permit children to participate in the Survey, and we do not knowingly collect information from children. By participating in the Survey, you represent that you are 18 years of age or older.
9. International Storage
Your personal information may be stored and processed in any country where we have engaged a service provider. By your participation in the Survey you acknowledge that we may transfer information to countries outside of your country of residence, which may have different data protection rules than in your country.
